Note from EPLAW President Jochen Pagenberg:
"Negotiations about the finalisation of the texts of the Unitary Patent Regulation draft and the United Patent Court Agreement have resulted in numerous papers and new text versions every week (the latest version dated 11 November may be found here). The Polish Presidency and the Commission try everything to conclude the work in December which many regard as premature. Member States and User organisations - including EPLAW - have asked for numerous amendments and warn against failure. One of the major concerns is too much involvement of the ECJ in future patent litigation.
"EPLAW Board members have participated in the discussions at the Venice Judges Meeting and the last Expert Meeting in Brussels on 18 November. We wish to inform and discuss with EPLAW members the options.
"Further, we will discuss several other topics of interest for harmonization of patent litigation practice in Europe: inventive step, indirect infringement and prosecution file history in infringement proceedings."

EPLAW and Venice's Judges' desire to move substantive patent law away from the regulation on the unitary patent to ask for a jurisdiction of exception where patent litigations would not be subject to the same requirements than any other litigations.
Hopefully, this has been rejected by rapporteur Rapkay and even the EPLAW's friendly chairman of JURI, K-H Lehne.
