Upon my reading of CA/D 16/13, if a communication issues and then oral proceedings are later set, you can withdraw before 4 weeks from the oral procs, and still get the refund, even though a communication issued earlier and you did not withdraw then. So a summons to oral procs seems to effectively open a window for getting the 50% refund, even if the window was previously closed because there was an earlier communication. It thus seems that appellents are encouraged to wait for a summons to oral proceedings before withdrawing if there has already been an earlier communication. This seems at odds with the stated goals.
