In an appeal against a preliminary injunction granted by the Stockholm District Court, the Svea Court of Appeal tried whether the validity of the disputed patent had been established as probable while taking into account also the possibility of the patentee (McNeil) requesting a reformulation of the patent claims during the main invalidity proceedings.
