Alk-Abello A/S v. Stallergenes, District Court The Hague, The Netherlands, 7 July 2010, Case No. HA ZA 08-1445
Patent related to the treatment of allergies. The District Court finds that a prior publication by Hansel dating back to 1970 is novelty destroying. Question was whether this Hansel publication also disclosed 'gradually progressing desensitization'. The court refers to a hand book by Hansel from 1975, which -according to the court- can also be taken as a starting point to assess novelty since it also discloses all other features of the claim, and finds that Hansel indeed discloses the feature.
